Fulton Co. Deputy says arrest was unlawful

ATLANTA, Ga. -

The Fulton County Sheriff's Office Sergeant arrested for the illegal operation of  a night club is firing back.

The attorney for Devon Brown says his client's arrest was unlawful.

Nine police officers entered the club on Metropolitan Parkway to check the club's licenses.

Police say the club was illegally operating without the required licenses.

Brown's attorney, George Plumides, said no money changes hands, no cover is charged at the door and you can't buy alcohol.

Plumides added that the nude entertainment is not an every night thing.

Plumides says its not about the alleged sex acts or nude dancers, it's about one question - is the club public or private?

Plumides says since the club is private, it does not have to adhere to the same alcohol and business regulations

Brown remains on the Fulton County Sheriff's staff, but is on personal leave.

He's due back in court next month.
