Burrell Ellis' attorneys: Case should be dropped

Attorneys for suspended DeKalb County CEO Burrell Ellis argued in court on Friday that the case against him should be dropped.

Ellis is set to stand trial for allegedly using his influence to shake down vendors and contractors for campaign contributions. His indictment includes 14 felonies.

Lawyers say that indictment should be thrown out because Ellis was acting as a peace officer who should have been allowed to sit in while the  special grand jury was hearing evidence in his case.

On Friday, Ellis' former chief operating officer, Richard Stogner, took the stand to back up that argument.

Prosecutors say Ellis was not allowed to observe the proceedings because he is not a peace officer.   

On Thursday, District Attorney Robert James was ordered to testify during the motions hearings. He said there was the ample evidence Ellis was shaking down vendors, including audio recordings.
