Source: Driver in fatal garbage truck crash had BAC 3 times above legal limit

ATLANTA -

The investigation a fatal crash of a city of Atlanta garbage truck has expanded.

A passenger in the sanitation truck was killed and the driver was seriously injured in the crash, which happened Saturday afternoon on Interstate 75 at Cleveland Avenue.

FOX 5 has learned that a GBI lab test showed that the driver had nearly three times the amount of alcohol in his system allowed for an industrial truck driver. Sources who saw the lab results tell FOX 5 that it indicated the blood-alcohol content was .136. The legal limit for most drivers is .08, while industrial truck drivers have a limit of .05.

FOX 5 previously reported that vodka
was found in the cab of the truck after the crash.

Gina Pagnotta-Murphy, president of the Professional Association of City Employees (PACE Atlanta), said investigators are working to determine what city workers saw before the employees left for work and when they broke for lunch.

"The city is trying to get a grasp on whatever before, in the middle and now," said Pagnotta-Murphy.

The workers union is anticipating that the city will step up random drug testing of city employees.

"We know it's needed and we want to make sure it's still done fairly and done by legally and it's done by everyone, not just from outside folks now, also up the chain, up the ranks, alcohol and drugs just don't happen at the lower people," Pagnotta-Murphy said.

The city attorney is also preparing for the possibility of a civil lawsuit.
