Murder, aggravated assault charges against Sneiderman dropped

DEKALB COUNTY, Ga. -

A judge agreed to drop serious charges against Andrea Sneiderman on Friday.

DeKalb County District Attorney Robert James introduced the motion to drop the malice murder and aggravated assault charges on Friday.

James said that he's not 100 percent that Sneiderman is guilty of murder.

"I believe that it would be unjust and unethical for the DA's office, for the state, for the district attorney of this county to go forward on a charge that I am not 100 percent sure of someone is guilty of," James told DeKalb County Superior Court Judge Gregory Adams.

Adams later accepted the offer.

A source had confirmed to FOX 5 Senior I-Team Reporter Dale Russell on Wednesday that James would likely go forward with dropping the charge.

It's been almost a year since Sneiderman was charged as a co-conspirator. The murder charge stemmed from a 16-count indictment that left her in jail for approximately three weeks in August 2012.

At the time, James made some pointed assertions about there being plenty of evidence of Sneiderman not only conspiring, but convincing her boss – Hemy Neuman – to kill her husband, Rusty Sneiderman. The latter had just dropped off his son at a daycare in Dunwoody in November 2010, when an assailant fatally shot him.

In March 2012, Neuman was found guilty, but mentally ill of killing Mr. Sneiderman. His widow continued to refute her involvement with her husband's death and having an affair with her boss, Neuman. She claimed he was obsessed with her and she didn't feel comfortable discussing it with her boss because she thought it would jeopardize her career.

James said that during discovery – the process where attorneys exchange evidence – that they've learned information that led him to asking to drop the charges.

Sneiderman's attorney, Thomas Clegg, said that while he believes that prosecutors "knew all along they didn't have a murder case," he welcomed James' request to drop the charges.

Sneiderman is still facing 13 charges from the indictment, including making false statements and perjury.

Sneiderman's attorney asked for a six-month continuance on the remaining lesser charges because of all the attention the case has received, but the judge rejected that

Jury selection for the trial is slated to begin on Monday. The initial jury pool includes 283 people. The judge said that 300 more people could be called if necessary.
