The DeKalb County Zoning Board of Appeals denied the requests of two county commissioners and homeowners to rescind a permit for a subdivision on Wednesday.
Opponents say the developers' plans to cut down 89 trees and clear land would permanently alter the Druid Hills Historic District. The subdivision is on the National Register of Historic Places.
Druid Hills Civic Association President Bruce MacGregor claims the county violated its own laws when it issued Robert Buckler a land disturbance permit to cut down and build a seven-lot subdivision called Clifton Ridge.
"The code says before you do anything that has a material change in appearance you have to have approval from the Historic Preservation Commission. That was not done," said MacGregor.
Members of the Druid Hills Civic Association say there have already been seven lawsuits on the proposed subdivision, but they're raising money for a legal fund and plan to take their case back to court.
