Family of boy struck and killed say FedEx driver to blame

DEKALB COUNTY, Ga. -

The parents of a 5-year-old stuck and killed by a vehicle say their hearts are broken. DeKalb police are still trying to determine who hit Robert "Buddy" Love as he was walking home with a schoolmate.

The fatal accident happened at the Kensington Station Apartments off Memorial Drive on Tuesday.

Love's parents say their son had just gotten off of a school bus and was feet away from his home when he was killed.

Twana Bonner couldn't hold back tears as she described losing a son.

"God knows I love my baby so much," said Bonner.

While police continue to investigate the death, Love's family says they have no doubts.

"It is our opinion that this accident was caused solely by the negligence of the Federal Express driver," said the family's attorney, Forrest Johnson.

"I just want him to know he took a very important part of our life away. There's nothing to replace it," said Robert Love Jr., the victim's father.

SkyFOX 5 showed police impound the FedEx truck that many have been involved. The family's attorney says the 10-year-old who was walking with Love saw it all.

"The FedEx driver came behind them at a high rate of speed, the FedEx driver almost hit him. He moved out the way. The FedEx driver then made contact with Buddy," said Johnson. "The boy was hit and he lay on the pavement."

DeKalb police questioned the FedEx driver but let him go. They say witness statements have been conflicting.

As a mother and father grieve their young son who loved school and football, the family attorney says the FedEx driver's own words incriminate him.

"When the truck driver finally was stopped by all of the neighbors who came from their various homes, he got out the truck and said he was lost, he didn't know where he was going and didn't realize he had hit anyone," said Johnson.

The family attorney says he has talked to six or seven witnesses who say the FedEx truck hit the boy.

Johnson says the family will file a lawsuit.

The FedEx corporation released a statement saying they are cooperating with police.
