UNION CITY, Ga. -
The attorney for a19-year-old shot and killed by a Union City police officer has filed a wrongful death lawsuit.
Attorneys for the family of Ariston Waiters filed a wrongful death lawsuit on Wednesday. The Waiters' attorneys say the civil suit is the family's attempt to seek justice for the 19-year-old's death.
A Union City police officer shot and killed Waiters last December reportedly while trying to handcuff him. The officer also said Waiters tried to take his gun.
The family believes a different version of events.
"He was unarmed. He was not running. He was not involved in any illegal activity when he was ambushed by a Union City police officer in the woods behind the townhomes in Union City," attorney Mawuli Mel Davis said.
Davis says the family also wants damages for the 15-month-old daughter Waiters left behind.
He added that Union City Police Officer Luther Lewis is back on the force after receiving no disciplinary action.
State investigators looked at the case and said they found no wrongdoing.
