Residents claim former Braves player running illegal halfway home

WALTON COUNTY, Ga. -

Residents in Walton County have filed a lawsuit claiming that former Atlanta Braves player Otis Nixon has been running a substance abuse home without the proper paperwork.

Neighbors said that for two years, they have been battling Nixon over the home, which is located on Dally Road in Covington.

"He was basically just running an illegal operation knowing that the resident in this community were really against it in this location," said Tony Smith.

Residents said that the area is not zoned for that type of housing.

Smith said that most of the people in the community have large farms and several kids. Smith said he had four girls.

"They're not allowed to go down there and ride their bikes or walk down to that house due to the fact that I don't who they're going to meet in the street," Smith said.

Nixon applied to rezone the property in 2010 but was denied. He withdrew that request before the full county commission could take up the issue. Neighbors said that he continued to run the center in violation of the zoning.

According to a police report, officers were called to the house on September 20 after a fight broke out between two residents. In the report, Nixon admitted he ran a halfway house.

"I spoke to the complainant Otis Nixon…He stated he runs a rehab center for men, and any consumption of alcohol, and/or drugs is a violation of the rules," the police report states.

Residents said that Nixon may have gotten away with the home because a loophole in the zoning law allows for up to eight family member or friends to stay in the home without a permit.

Code enforcement officials attempted to serve Nixon legal papers, but he claimed that he was being evicted. Officials said they would look for Nixon on Thursday if they don't see him on Wednesday.

Nixon was not able to be reached for comment.
