Gwinnett County Police investigators arrested 33-year-old, Gary Miles Jr., who was a former police officer with the department, and charged him with one count of Battery and one count of Violation of Oath of Office by a Public Officer.

On June 9, 2009, investigators started conducting a criminal investigation immediately after the departments Professional Standards Unit (Internal Affairs Unit) received information regarding possible criminal conduct by a Gwinnett County Police office.

Investigators said an incident occurred on February 16, 2009 at the Waffle House located at 2725 Loganville Highway in Loganville. The victim, who was an employee at the location, reported that an on-duty police officer came into the restaurant to eat and without provocation was tasered by that officer.

During the course of the investigation, the officer was identified as Corporal Gary Miles. Investigators said there was enough probable cause to arrest Miles. He surrender to investigators without incident and transported to the Gwinnett county Detention Center.

Miles, a 6 year veteran with the Gwinnett County Police department, resigned his position earlier this week.
