I-Team: Video Sheds Light on Shooting

The family of the man shot by an off-duty Atlanta police officer said a surveillance tape backs up their son's story.

Atlanta Police have said Tramaine Miller was shot after an off-duty officer saw him in a known drug area, acting suspiciously, and running to his car when confronted.

Senior I-Team reporter Dale Russell obtained a copy of a surveillance tape that the family believes contradicts that story.

There were four cameras rolling that night. They show Tramaine Miller casually walking into an apartment complex and casually walking out. However, the cameras do not capture the shooting, which leaves a gap of around 40 seconds. The family of the shooting victim want to know what happened in that short period of time that would cause an officer to shoot.

The video shows paramedics rushing Tramaine Miller to the hospital, shortly after he is shot in the face by an off-duty Atlanta Police officer. Reverend Derrick Rice and others believe the video shows something else.

"I'm astonished on some levels, relieved on others," said Rice. "You think this video backs up Tramaine Miller's story?" asked Dale Russell. "Absolutely," said Rice.

The shooting took place in the parking lot of City Views at Rosa Burney Park apartments, near Turner Field. Police said the nearby park is a haven for drug dealing.

Officer Reginald Fisher was working off-duty at the complex.

"He saw what appeared to be a suspicious person in an area where there had been high-drug trafficking in the past," said Lt. Keith Meadows.

Miller's family has always contended Tramaine was only at the apartments to help his aunt with her medicine.

After examining the surveillance tape, Miller's father, Greg Rollins, and family lawyer, Mawuli Davis, believe they can see Tramaine Miller's silver Charger coming down the street. Seconds later, Tramaine's headlights from his car flash as he pulls in to parking lot. Then, some thirty seconds later, Tramaine Miller walks inside.

"Was he running? No, he walked in and walked out, never ran, never came from a park," said Davis.

Video shows Miller turning down the main floor hallway -- the floor where his quadriplegic aunt lives.

"From the start, the family said he's going to deliver medicine, once he was finished there returning home," said Davis.

The video shows Miller was inside for about three minutes. He walks out, past the camera and towards his car.

This is how Atlanta Police described what Tramaine did the night of the shooting.

"He ran and jumped into a silver Dodge Charger. At some point, the subject reached underneath the front seat of the car and the officer felt threatened," said Meadows.

Based on witness statements to the police, the altercation with police officer Reginald Fischer took place less than a minute after Tramaine Miller walked to his car.

"I'm satisfied the police officer is dead wrong, (he needs) to come forward as a man and say 'I was wrong,'" said Rollins.

The shooting itself is not captured on camera. But you can see the aftermath, as neighbors and then later paramedics rush to the scene.

Davis said it's time for police to fire and prosecute Officer Reginald Fischer.

"What you've shown us, substantiates what has been said by all witnesses. The only person inconsistent is the officer," said Davis.

FOX 5 asked Atlanta police for a comment on the surveillance tape and what they think it means. Officials had no comment.

One high ranking APD officer said the tape doesn't tell them much. Another APD source acknowledges that there is no suspicious activity seen on the tape, but asks what happened in the 40 seconds or so after Tramaine Miller walks out of frame.
