ATLANTA (MyFOX ATLANTA) - General Larry Platt's performance at Atlanta's "American Idol" auditions became an overnight sensation and his song "Pants on the Ground" went viral on the internet. At least one pirated version has emerged and there are now questions about who will profit from the Platt's creation.
A remix of the unforgettable song, "Pants on the Ground" is out and Platt isn't happy.
The self-proclaimed Atlanta civil rights soldier said royalties from his one-hit-wonder belong to him and no one else. Not surprisingly, others want a piece of the action.
At Platt's Atlanta home on Tuesday, the "American Idol" breakout star was still singing his now famous song.
No one could have predicted that the "Pants on the Ground" tune would become a sensation, Platt says he is now being taken advantage of.
"I think it's bad to get money and I don't get [anything] and everybody else is getting money off of my song," Platt said.
Platt's song has been remixed for the radio.
Stations like V-103 are always looking for the next big hit. The station's radio personalities say they play Platt's song because he came in and sang it for them.
But as far as putting pirated version of the song on the air, V-103's Greg Street said, "Unfortunately, a lot of people who know a lot about the business, know a lot of people don't know about the business."
Just five days after Platt's appearance on "American Idol," two patent requests for "Pants on the Ground" were filed with the U.S. trademark Office and they weren't by Platt.
"I'm sure he had no idea it would take off like it has," said Atlanta entertainment attorney Alan Clarke.
Clarke advised Platt to act fast. "If [Platt] gets good, competent legal counsel, he can claim the first use of it and the first use in commerce," said Clarke.
Platt is following Clarke's advice and has secured a lawyer to take action.
